Backmarket seller refuses to reimburse me

I will try to be short but I have a dispute opposing a seller of the Backmarket platform.
I bought a reconditioned phone that I returned after a year (still under warranty). There he sends me after several weeks a new phone which turns out to be defective. I send him back and again not news for several weeks. I directly contact the platform that supports and announces the reimbursement to avoid waiting longer. They ask me to monitor my account and contact them if in a few days nothing appeared on my account. What I do so. It is then that the next day I receive an email from the supplier who tells me that my phone is on the way.
I receive him and again he is defective, I even wonder if they did not send me the same phone.
I return it by asking for the refund, possibility offered on the return voucher.
Once again not news, so I contact the seller who announces the reimbursement and who 2 days after retract and ask me for my address for delivery. (I save you the details also of recipient error. )). I then contact Back Market who tells me that I will be reimbursed and also withdraw by telling me that it is contrary to the SAV regulation.
My question is therefore: are they obliged to reimburse me and how can I force them to do so. It’s been 6 months since I no longer have this phone.

I testify here of a very unfortunate experience with the Backmarket site.
I order a Samsung A5 on October 24, 2019 at 80 euros on this site (which is a very attractive price). But from November I identify a network connection problem between the SIM card and the device (very little network, a single bar and as soon as I move, the conversation is cut). I therefore send them a message explaining the technical problem to them on the device, and that I inserted the SIM card into another phone, and that it worked very well.
During these exchanges by electronic messages (which still lasted 3 weeks. ), I managed to send them a 2 -minute video explaining this technical problem precisely.
So they send me a good Colissimo and a return sheet to be completed by me in order to summarize with detail the elements of the technical problem.
So I send my phone to December 15, 2019, and on the 27th, I send them a message to have news of the repair procedure possibly underway.
What was my surprise when I received the following answer .
“Good morning. Your phone has just returned from the technical service and it has not detected any anomaly on your device.
I therefore invite you to send us a good comeback so that we will pay you your phone..
Yours “.
As if I had that to send them a functional phone. The person who sent me this message clearly laughs at all the efforts I have endured in order to find a solution to this defective phone problem.
I tell you that it won’t stay there. I demand a refund as soon as possible from Back Market, which my interlocutor “pro phone” refuses that “my phone works”.
Otherwise I reserve the right to initiate prosecution to this company.

I have been in dispute with backmarket for 2 months. I returned my iPhone7 bought 6 months before, still under warranty because the battery had inflated and no longer walked (this confirmed by the diagnosis of Apple). I am told that my phone was opened, damaged and that they received it without battery.
I sent a phone for a simple change of battery and I find myself without anything and without any solution. I am in regular contact with them but they make me go around in circles promising to help me but nothing happens and we always come back to the starting point. I lost 300 € in this story when I thought I could trust this French and well rated society.
They are difficult to reach and make the exchanges last in order to drop I imagine.
I therefore strongly advise against this company which has a beautiful showcase but does not ensure in the event of a problem behind and I will get closer to my legal protection.

This phone suddenly started to heat (surely the battery), which twisted the framework . The frame of the frame broke the back of the phone which is fragile as glass and damaged the screen,
Photos were sent as the seller asked me, the answer was to tell me that, as the rear was broken, it was surely a fall and therefore the warranty did not work, so I am refused the return without further explanation.
We do not take into account the explanations of customers at all, the phone has never fallen, it has always been protected by a Rhinoshield shell deemed unbreakable and I did not have fun to voluntarily twist a phone which gave me to the whole satisfaction and which cost me almost 500 euros . It is not my fault if the components they use to recondition the phones are of poor quality .
It’s a shame. How to correctly assess a device on photos, it’s not serious .I am fully aware that a material or component can be defective but when we claim to be the number 1 of the reconditioning we provide with a real after -sales service and above all we take into account the explanations of the customers and we do not hastily conclude to avoid to reimburse or exchange a phone .

I am sincerely sorry for the embarrassment caused and apologized to you on behalf of Back Market.
The reconditioner mentioned exclusion of warranty because your device has been damaged.
Thus, if a dysfunction appeared on your product but it has been broken/oxidized/opened by a third party or has traces of impacts following a fall or shock, the warranty will no longer be applied and the Reconditioner will not be required to take care of your after-sales service request.
I can suggest you diagnose your device by a local repairer in order to know the cause of the screen breakage.

Back market: parcel lost during delivery
What if you ordered a product on the back market site and the order was lost during delivery ? Lost or stolen packages, here is how to be read or reimbursed thanks to our delivery dispute resolution procedure.
Article L. 221-15 of the Consumer Code specifies that the seller remains responsible for the good reception of the package by the customer, regardless of that he is responsible for delivery or that he entrusts the execution to a third party provider. So if your order has been lost or stolen during delivery you must turn against Back Market and not against the carrier.
Step 1: Contact Back Market for new delivery
Call
To start, call Back Market customer service on their non -surcharged phone number to open a complaint for lost packages. If all is well, they should offer you a new delivery or refund of your order.
Send a registered letter
If the response of the back market customer service does not satisfy you, send them a registered letter with acknowledgment of receipt to show your determination and to remind them that Back Market is automatically responsible for the proper execution of the order.
