The limited warranty for one year from Apple is a commercial guarantee of the manufacturer offered by Apple. It gives rights different from those you can have under the law, including, but without limiting themselves, those relating to non -compliant products or products with hidden defects.
Consequently, the advantages conferred by the limited warranty for one year of Apple are added to the rights provided for by law and do not replace them, as described below.
Rights granted by the legal guarantee
Apple remains responsible in all cases in matters of applicable legal guarantee, in particular (i) in the event of non-compliance, as defined in articles.217-4 and following, and (ii) in case of hidden defects, as defined in articles 1641 and following of the French Civil Code.
Regarding the guarantee of conformity, under article L. 217-4 of the French Consumer Code: “The seller delivers a good in accordance with the contract and responds to existing compliance defects during issuance. He also responds to compliance defects resulting from packaging, assembly instructions or installation when it has been charged by the contract or was carried out under his responsibility. »»
Under article L. 217-5 of the French Consumer Code: “The good is in accordance with the contract:

Article L. 217-16 of the French Consumer Code: “When the buyer asks the seller, during the price of the commercial guarantee which was granted to him when the acquisition or repair of a movable property, a restoration Covered by the warranty, any immobilization period of at least seven days is added to the duration of the warranty which remained to run. IMPORTANT: The conditions of the limited warranty for one year of Apple do not apply to legal warranty requests.

That this guarantee covers ?
Apple International Distribution, LTD. Based in Hollyhill Industrial Estate Hollyhill in Cork, Republic of Ireland (or his right) (“Apple”) guarantees the material and accessories of the Apple brand contained in the original packaging (“Apple product”) Against any material and manufacturing defect if they are used in accordance with Apple user manuals, technical characteristics and other directives concerning an Apple product published by Apple for a period of one (1) year from of the original purchase date by the final buyer (” Period of guarantee “)). In addition, Apple undertakes to provide a telephone assistance service for a period of eighty-dix (90) days from the delivery of Apple products, if customers wish to benefit from technical advice from Apple.
That does not cover this guarantee ?
This warranty does not cover the hardware and software of a brand other than Apple, even if it is sold or wrapped with Apple equipment.
Products that do not bear the Apple brand can benefit from a specific commercial guarantee from the manufacturer, giving them advantages in addition to legal rights (in particular the guarantee against compliance defects and hidden defects). You can get services in the countries of the European Economic Area (EEE) and Switzerland without paying any shipping and handling costs. Outside this region, service options can be limited. If a given repair service option is not available for the Apple product in said country, Apple or its agent must inform you of any additional costs that may apply to shipping or handling before the service is rendering. Shipping and handling costs will not apply in countries where Apple has an Apple Store store or an Apple approved service center (“CSAA”) (an updated list of service centers is available to Locate address.Apple.com/fr/fr/).
When you contact Apple by phone, costs may apply according to your location. Please inquire with your network operator.
This warranty does not apply: (a) to consumable parts, such as batteries or protective coatings provided to wear out over time, unless the damage is due to a lack of materials or manufacturing; (b) aesthetic damage, including, but without limiting itself, scratches, scratches or broken plastic elements of the ports, unless the damage is due to a lack of materials or manufacturing; (c) to damage caused by use with a component or product of a third party that does not respond to the characteristics of the Apple product (the characteristics of Apple products are available at www.Apple.com/fr/, under the technical characteristics of each product, and are also available in stores); (d) damage caused by an accident, by abusive use, by improper use, by fire, by an earthquake or by any other external cause; (e) for damage caused by the use of the Apple product not in accordance with the directives published by Apple, whether it be the user guide, technical characteristics or other directives; (f) damage caused by any intervention (including upgrades and extensions) carried out by any person who is not an Apple representative or an Apple approved service center (“CSAA”); (g) to an Apple product that has been modified to alter its functionality or capacities without the written authorization of Apple;(h) damage resulting from normal wear or normal aging of the Apple product; (i) If a serial number of the Apple product has been removed or degraded, or (j) if Apple receives from the competent public authorities of the information indicating that the product has been stolen, or if you cannot deactivate Password protection or other security measures provided to prevent unauthorized access to Apple product and that you cannot prove that you are the authorized product user (p. ex., by presenting proof of purchase).
Important restrictions
Apple can restrict the Apple Watch warranty and Apple TV to countries where Apple or its approved resellers sell the device.
With regard to iPhone and iPad devices capable of accessing a cellular network, the guarantee provides a repair service within the countries of the European Economic Area (EEE) and Switzerland. Outside this region, service options can be limited for technical reasons that escape Apple control. With regard to iPad devices, the warranty is not applicable in China due to differences in WiFi connection escaping Apple control.
Your responsibilities
If your Apple product can store software, data and other information programs, we recommend that you make regular backup copies of the information contained on the storage medium of your Apple product to protect the content and Protect yourself against possible operating failures.
Before submitting your warranty request for your Apple product, we advise you to make a copy of the content of its storage media, delete all personal information and deactivate all the safety passwords. After providing the warranty service, your Apple product or a replacement product will be returned to you with the original configuration of the Apple product at the time of its purchase, subject to applicable updates. You can request to benefit from a repair in a country that is not the country of purchasing. In this case, you will be required to comply with all applicable laws and regulations concerning import and export, and you will be liable for customs duties, VAT and other taxes and related costs.
Important: Do not try to open the Apple product, unless the user manual tells you how to do it, and do not remove any of the protections set to the Apple product. Opening the Apple product or withdrawing the protections can cause damage that is not covered by this warranty. Only Apple or a CSAA is authorized to repair on this Apple product.
What Apple does in the event of a warranty request
If, during the warranty period, you submit a complaint to Apple for this guarantee, Apple, at its discretion:
(i) will repair The Apple product using new or previous Apple or previous parts that have been tested and meet the Apple functional requirements, or

For requests made in a country other than the country of purchase of the Apple product, Apple can repair or replace products and parts with comparable products and parts, in accordance with local standards. If you do not have internet access or if the Apple product still does not work properly after using these resources, please contact an Apple representative or, if necessary, an Apple store (“Apple Store store”) or a CSAA. It will help you determine if your Apple product requires Apple intervention and, if necessary, will inform you about the warranty service options defined below which will be provided by Apple.
Before being able to benefit from the guarantee service, Apple or its agents may ask you to provide proof of purchase, answer questions in order to help them diagnose potential problems, or follow Apple procedures for Obtain the warranty service, such as monitoring the packaging and shipping instructions for Apple products in the event of a postal return service, depending on the description below.

Guarantee Service Options
Apple will provide a warranty service through one of the following options:
(i) store repair service. Apple can ask you to return your Apple product to an Apple Store store or to a CSAA which offers the repair service in store. Your Apple product can be sent to an Apple repair center (“CRA”) to be repaired. Once you are warned that the repair is complete, you can recover your Apple product from the Apple Store store or the CSAA, unless Apple informs you that your Apple product will be returned to you directly by the CRA.
(ii) Repair by post. If Apple decides to ensure the guarantee by means of its return service by postal sending, Apple will send you pre -rant shipping slips and, if necessary, the packaging equipment and the instructions explaining how to pack and send your Apple product , to allow you to ship your Apple product to a CSAA or CRA. Once the repair is finished, the CRA or the CSAA will send you the Apple product. (iii) spare parts service to assemble yourself. As part of this service, Apple provides you with a replacement product or easily replaceable parts or accessories, such as a mouse or a keyboard, which can be replaced without tools. Apple will send you a product, a part or a replacement accessory with the installation instructions, if necessary, and any condition to be observed for the return of the product, the part or the accessory replaced. Limitation of liability
i) Integrality of the agreement:
With the exception of the rights which are granted to you by the law on consumer protection, as it is specified at the beginning of this document, all the guarantees and other conditions which are not stipulated in this guarantee document (that this either by oral or in writing) are, to the fullest extent authorized by law, excluded from the limited warranty for one year of Apple.
ii) Discharge concerning data:
Apple does not guarantee, does not declare or promise being able to repair or replace an Apple product under this risk -free and/or loss of information and/or data stored on Apple Product. (Please refer to the “your responsibilities” part above.))
III) Limitation of responsibility:
In no case can Apple be held responsible for the following:
- loss of profits; Or
- loss of activity; Or
- drop in surveys and/or other similar losses; Or
- loss of early savings; Or
- loss of goods; Or
- loss of contracts; Or
- lack of use; Or
- loss or damage of data or information; Or
- any damage, loss, expense, expense or special cost, indirect, consecutive or purely economic.

Apple rejects to the extent allowed by law any responsibility for the guarantees provided for by law or implicit, including, without limiting itself, guarantees of market quality and adaptation to particular use and guarantees against Hidden defects. Coverage of this warranty
Apple Canada Inc. Located at 120, boul. Apple can limit the guarantee service for material products in the country where Apple or one of its approved distributors has originally sold the device.

Before offering you the guarantee service, Apple or its agents may require that you provide details of your proof of purchase, that you answer questions designed to facilitate the diagnosis of potential problems and that you follow the procedures established by Apple To benefit from the warranty service. You are responsible for reinstalling all your other software programs and the configuration of all your data and information. The recovery and resettlement of software programs, data and other information is not covered under this warranty.
Important: do not try to open the Apple product or remove any protective cap fixed to the product. The opening of the Apple product or the withdrawal of protective caps can cause damage that is not covered by this warranty. Only Apple or an FSAA are authorized to carry out the repair services of this Apple product.
What Apple will do in the event of a violation of this warranty
If, during the warranty period, you submit a valid complaint to Apple or an FSAA, Apple can at its discretion:
(i) Repair the Apple product using Authentic Apple Apple or authentic used Apple parts that have been tested and meet the Apple functionality criteria,
(ii) replace the Apple product with a device of the same model (or, with your consent, by a product with characteristics similar to those of the original product or the same characteristics as the latter (for example, a different model offering the Same features as the original or the same model, but of a different color)), whether the latter is new or equipped with authentic used Apple parts that have been tested and meet the Apple functionality criteria, or
(iii) take up the Apple product and reimburse the purchase price.
Apple may ask you to replace certain Apple products or certain parts installed by the user. The replacement parts or Apple replacement products, including the parts installed by the user installed in accordance with the directives provided by Apple, are covered by the remaining duration of the warranty or for ninety (90) days from the date of repair or replacement if this last period is of a higher duration. When replacing a part or an Apple product or during a refund, the replacement product becomes your property and the replaced or reimbursed product becomes Apple’s property.

Guarantee Service Options
Apple will provide the guarantee service according to one of the following options:
i) Store repair service. You can bring your Apple product to an Apple Store or an FSAA offering a store repair service. Repairs on your Apple product will be carried out on site or in an Apple repair center (a “CRA”) chosen by the Apple Store or the FSAA. After being notified that the repairs have been carried out, you can prompt your Apple Store or FSAA product promptly, unless your Apple product is sent to you directly from Crack.
(ii) Post repair service. If you do not return the part or the Apple product replaced in accordance with Apple guidelines or if you return an Apple part or product that is not covered by this service, Apple will make the authorized amount on your credit card brought.
(b) service not requiring the return to Apple of the part or the Apple product replaced. Apple will send you at no cost an Apple product or a replacement part accompanied by the instructions for its installation, as the case may be, as well as the Directives for the Reduced Part or the Apple Product replaced.
(c) Apple is not responsible for the costs of labor engaged in relation to the repair carried out by the customer using the parts service. You can contact Apple to the number indicated below to get additional help.
Apple reserves the right to modify the method that Apple chooses to use to provide you with the guarantee service, as well as the eligibility conditions of your Apple product to a specific service method. The services offered will however be limited by the options offered in the country in question. Service options, availability of parts and processing times may vary depending on the country. To carry out repairs, Apple can use products or replacement parts from a country other than the country where the Apple or the original part has been obtained. You may have to assume the costs of handling and shipping of covered equipment if the latter cannot be repaired in the country in which it is. If you wish to claim service in a country other than the country of purchase, you must comply with all the laws and all the applicable regulations in terms of import and export, and you are responsible for the payment of all customs duties, VAT, and other taxes and related costs. Apple can repair or replace Apple products or parts using comparable Apple products or parts that comply with local standards where international repair or replacement services are offered.
Limitation of liability
Subject to the provisions of this guarantee and to the full measure allowed by applicable laws, Apple is not responsible for direct, indirect, individual or accessories damage from a guarantee or condition violation or by virtue of any other Legal provision, including, without limiting itself, loss of use, loss of revenue, loss of real or anticipated profits (including the loss of profits made by the company), the loss of use of Fund, loss of early savings, loss of customers, loss of business opportunities, loss of traffic, loss of reputation and loss of data or their damage, compromise or corruption, nor losses or Consecutive damage caused in any way, including the replacement of equipment or goods, recovery costs,Programming or reproduction of programs or data stored on the Apple product or used in hand with it and the failure to ensure the confidentiality of the information stored on the Apple Product.

Apple makes no declaration as to its capacity to repair an Apple product under this warranty or to replace it without risk for data stored in the Apple product or without loss of these.
Certain provinces do not allow the exclusion or limitation of accessory or indirect damage, it is possible that the previous exclusion or limitation does not apply to you. Quebec residents are subject to consumer protection legislation of this province.
No reseller, employee or agent of Apple is authorized to make any modification, extension or adding whether to this warranty. If any provision of these is deemed illegal or not enforceable, the legal and enforceable nature of the remaining provisions will not be affected or limited. This guarantee will be governed and interpreted under the laws of the country in which the Apple product has been purchased. Apple or its beneficiaries are the guarantors under this guarantee.

What Apple will do in the event of a violation of this warranty

Apple will provide the guarantee service according to one of the following options:
