General conditions of use of the SFR Mail service November 12, 2020
Article 1: object
The purpose of this document is to define the special conditions for using the SFR Mail service. This service is reserved for SFR subscribers and is for indefinite. Eligible people are below called “the user”.
SFR reserves the right to cancel the registration in the SFR Mail service in the event of expiration, for any reason whatsoever, of the user’s subscription contract whose special conditions constitute the accessory.
Article 2 – Description of the SFR Mail service
The SFR Mail service allows:
- Compose, send, consult, transfer, respond to emails to email boxes from all email providers from the web interface, messaging software or mobile application.
- Be able to subscribe to the SFR Cloud service to store its attachments (whose general conditions are attached to the appendix) if the user is eligible and holding a compatible offer.
The reception box has a maximum capacity (see support page of the SFR Mail service), beyond the reception and storage of new messages are no longer guaranteed.
The SFR Mail service is accessible from a computer, a tablet and/or a smartphone connected to the Internet network, subject to compatibility of the service with the operating system as well as the Internet browser of the terminal of the terminal ‘User.
In order to improve the user experience and guarantee the proper functioning of the service, SFR Mail is accompanied by an anti-spam function. The anti-SPAM is an automatic processing tool to filter and limit the reception of unlined and malicious electronic letters.
Electronic letters identified as unlined or malicious by the anti-spam will be automatically placed in the “undesirable” folder of the SFR Mail messaging box and will be marked with the prefix “*** spam ***”. Unwanted emails will be automatically erased after 5 days, from their reception. Thanks to the “spam” report function, the user can himself identify an email as being unsolicited or malicious and thus improving the operation of the anti-spam.
In order to guarantee the operation of the anti-spam, the user accepts that all the messages received on the SFR Mail reception boxes be analyzed by the automatic anti-spam processing tool.
Article 3 – Communication of registration elements
The user undertakes to indicate to SFR any change or any subsequent modification of one of his personal information, communicated during registration in the service. Otherwise, SFR will no longer be able to provide the provision of the service, which the user recognizes and accepts.
To access the SFR Mail service, the user must enter their SFR password.
The user must imperatively preserve the confidentiality of this password in order to avoid any unauthorized or malicious use of a third party. The user is informed that in the event of disclosure of his password to a third party, he is solely responsible for all the consequences of the use which could be made of it. Any use carried out through the user password is deemed to be made by the latter.
In the event of forgetting his password, the user will receive a new password by SMS or email, after requesting it from the authentication page.
SFR cannot be held responsible for any loss or damage occurring due to the breach of confidentiality obligations incumbent on the user (in particular and not limited to: sending message by one or third parties).
SFR undertakes to take the necessary measures aimed at ensuring the protection, integrity and confidentiality of the information provided by the User and that sent by SFR, as part of the use of the Service.
Article 4 – Financial conditions
Registration in the SFR Mail service is free, as well as sending/receiving, consultation and e-mail archiving.
Article 5: account inactivity/termination/cancellation
In the absence of use of the SFR Mail service for a period of 6 consecutive months, SFR reserves the right to block access to the user’s SFR Mail account. If this inactivity continues beyond 12 months, SFR reserves the right to deactivate the user’s sfr mail account. In this case, its email address and all of its content are definitively deleted.
Regarding users, SFR mobile subscribers, in the event of the termination of the service or termination of their mobile subscription, they lose their address [email protected], and the data associated with this address, once their effective termination.
In the event of unfair, fraudulent or prohibitive service as described in article 6 of these, SFR reserves the right to suspend or terminate after notification to the User, access to the SFR Mail service.
In the event of a final stop of the service by SFR, the user will be informed beforehand.
Article 6 – Responsibility
It is expressly recalled that SFR cannot be held responsible in the event of loss of any data, email, or information, stored by the service, as part of personal, professional and/or commercial use that the user will have chosen to ‘Apply, even though it would cause indirect damage for the latter, such as, in particular, loss of turnover, profit, profits, customers or other loss of income.
In addition, SFR cannot be held responsible for any damaging fact, which occurred by the occurrence of a case of force majeure, as defined by the case law.
It is up to the user to take all appropriate measures to back up your data, emails and information.
It is expressly recalled that the Internet is not a secure network. The secret of correspondence transmitted to this network is not assured.
The user therefore acknowledges being informed that the integrity, authentication and confidentiality of information and data of any kind he wishes to exchange on the Internet cannot be guaranteed on this network.
The user should therefore not transmit messages from which he would like to see the confidentiality guaranteed to be infallibly.
The messages sent as part of SFR Mail are private correspondence and the user is the sole responsible for the messages sent. Nevertheless, he refrains from exchanging any prohibited, illicit, illegal, contrary to good manners or public order and infringing or being likely to infringe the rights of third parties and in particular their intellectual property rights.
The user also refrains from uttering abusive, defamatory messages or racist, violent or pornographic messages, messages likely to undermine respect for the human person and their dignity, equality between women and men, protection of children and adolescents.
He also undertakes not to issue messages encouraging the commission of crimes and/or crimes or encouraging the consumption of illicit substances, of messages encouraging discrimination, hatred or violence. The user refrains from usurping the identity of a third party when he sends messages from SFR Mail.
It is up to the user to take all appropriate measures to protect their own data and/or software, in particular contamination by possible viruses circulating on the Internet network or the intrusion of a third party into the system of its terminals at any end whatsoever and to make backups beforehand and after the use of the service.
With regard to the use of the Internet, the user is informed that the Internet is a network conveying data likely to be protected by intellectual property rights or to violate the legal provisions in force.
SFR is unable to control the content of the messages or data transmitted or received via the service, and therefore cannot in any way be held responsible for any damage whatsoever resulting from non-compliance with the regulations in vigor, error or omission in messages. In the same way, the user will have to be vigilant in the context of the use of the service, in particular to protect himself from possible harmful behaviors, such as phishing. SFR cannot be held responsible in the event of damage attributable to this type of fraud.
The user also acknowledges being fully informed of the defect in reliability of the Internet, in particular in terms of non-access of access, lack of security relating to data transmission and non-guarantee of data transmission performance.
The user forbids any fraudulent, abusive or excessive use of the service, such as in particular the voluntary or involuntary size of the SFR messaging servers and/or the recipients of messages or its network, or the sending of attractive messages necessarily generating an imposing number of responses, which can thus disrupt the availability of said servers or network. The use of the SFR Mail service is strictly limited to private use.
SFR cannot guarantee and, therefore, cannot be held responsible for dysfunctions or advenous breakdowns on the GSM network, the data network and the SFR servers which would not be its own fact as well as dysfunctions or breakdowns on interconnected networks in his own.

Article 7 – Personal data (“DCP”)
1. Applicable laws
SFR takes the measures capable of ensuring the protection and confidentiality of DCPs in its possession concerning customers and deals with them in compliance with the provisions of law n ° 78-17 of January 6, 1978 modified relating to computer science, files and European freedoms and regulations in force on the protection of DCPs (“regulations”).

4. Finality

5. Conservation durations
The DCPs are kept for the duration of the provision of services and/or for the duration of the specific treatments to which the customer has agreed and/or for the legal conservation durations.
6. Recipients
DCPs may be processed by the group authorized by the group, subcontractors, subcontractors, partners or service providers of SFR. If these subcontractors, partners or providers carry out treatments outside the European Union, they will then be made, in accordance with the regulations, on the basis of a decision to adequate the European Commission or to “contractual clauses types “.A copy of these documents can be obtained from the DPD of SFR. As part of the geo-localized services offered thanks to its network, SFR may have to communicate to a service provider or to a partner the customer location data who wishes to benefit from these services and which will be consented beforehand to be located.
9. Call recording
The customer is informed that his conversations with customer service are likely to be registered or listened to by SFR for probationary purposes and detection of fraud and/or to be studied in order to improve the quality of the service. These conversations are kept for a maximum of six months from their registration except regulations imposing a higher shelf life.
10. Rights of people
At any time, the customer can request access to the DCP concerning him, collected in the context of the detailed purposes above, the rectification or erasure of these (insofar as this does not prevent the right execution of the contract or compliance with the legal obligations of SFR) and the limitation of one or more specific treatments concerning it, under the conditions provided for by the regulations. The Customer also has the right to oppose a treatment of his DCP and the right to their portability, under the conditions set by the regulations.

Article 8 – Intellectual property
As part of the execution of this contract, SFR grants the user a right of use of the software (s) necessary for the use of the service under the conditions of this contract. This right of use cannot be detached from this service.
Article 9 – Force majeure
SFR cannot be held responsible for the partial or total non-performance of its obligations or any delay in their execution, if this non-performance or delay has been caused by the occurrence of unpredictable events, reasonably irresistible and outdoor. Will be considered in particular as unpredictable, irresistible and external elements, a government decision, a war, a civil war, a sabotage, a flood, a disruption in the sources of supply (such as, for example and without this list being limiting, The minutes of telecommunications, electricity and petrol), an epidemic, a strike, a lockout, a stop or an incident of machines, one or more computer viruses, an attack of one or more pirates, a fire , an explosion or any other independent event of the control of SFR and that the latter could not have reasonably avoided or overcome. Payment will remain due for the obligations already fulfilled and the parties will result in their accounts accordingly, without being able to claim any compensation of any kind whatsoever.
Article 10 – General provisions
In the event that any of the provisions of this contract would be declared zero or without effect, in any way and for any reason whatsoever, it will be deemed unwritten and will not lead to the nullity of the other provisions of this contract. The user acts in his own name and for his own account. He has neither the power nor the authorization to hire SFR in any way whatsoever. None of the provisions of the contract can be interpreted as creating, between SFR and the User a mandate, a subsidiary, an agent or employee relationship to employer. The User recognizes and expressly accepts that SFR may subcontract part of the obligations of this contract to one or more third parties.
The user cannot give this contract with the rights and obligations relating to it without the written prior agreement of SFR. SFR is authorized, at its sole discretion and without notice, to give in the benefit of this contract or any of its rights by virtue of present to any third party of its choice.
Article 11 – Applicable law
This agreement is subject to French law.
